Terms of Service

1. Acceptance of Terms

By accessing or using the Eheba platform (the "Site") and the services offered through eheba.com (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). If you do not agree to any part of the Terms, you must discontinue use of the Service immediately.

2. Intellectual Property

All intellectual property contained on the Service, including without limitation text, graphics, logos, brand assets, underlying code, and the structure and compilation of the site (the "Eheba Content"), is owned or licensed by Eheba. You may use the Service for personal, non-commercial purposes only, and you may not reproduce, modify, distribute, or create derivative works from any Eheba Content without express written permission. All trademarks, service marks, and trade dress on the Site are protected, and content may not be used in a way that implies any affiliation or endorsement without our prior written consent.

As between you and Eheba, any user-submitted content remains the property of its author, but you grant Eheba a non-exclusive, worldwide license to display, reproduce, and use that content in connection with operating and improving the Service, subject to our Privacy Policy and any applicable settings you choose.

3. Third-Party Links and Google Play Hosted Apps

The Service functions as a discovery platform for applications that are hosted and distributed on Google Play. We do not host these apps on eheba.com, nor do we modify their content or functionality. All app listings on the Site link to external pages operated by Google Play, and the availability, quality, and terms of use of those apps are governed by Google Play and the app developers.

Your use of any app accessed via Google Play is governed by Google Play's Terms of Service and Privacy Policy, and by any agreements you enter into with Google Play. Eheba does not guarantee the safety, reliability, or suitability of any third-party app and does not warrant that app content will remain current or free from defects. By engaging with third-party apps through the Service, you acknowledge and accept Google Play's terms and that Eheba bears no responsibility for those third-party offerings.

4. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." EHEBA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL EHEBA OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR ANY CONTENT OBTAINED THROUGH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EHEBA'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNT PAID, IF ANY, BY YOU FOR THE SERVICE IN THE PRECEDING 12 MONTHS.

5. Changes to Terms; Termination

We may update these Terms from time to time. We will provide notice of material changes and update the "Effective Date" accordingly. Continued use of the Service after such changes constitutes acceptance of the revised Terms. We may suspend or terminate access to the Service for conduct that violates these Terms or is harmful to other users or the Service itself.

6. Governing Law

These Terms and any disputes arising under or related to them shall be governed by the laws of the jurisdiction in which Eheba operates, without regard to conflict of laws principles. You agree to resolve disputes through binding arbitration or the courts as appropriate, subject to applicable law and arbitration rules.
